Where ACER does not own the copyright in all material included in an assessment, it is obliged to observe the rights of the relevant copyright holders.

Sometimes ACER will be confronted with orphan works where, despite its best efforts, it cannot identify or locate the relevant copyright owner. In those limited instances, where the relevant work has merit for educational purposes, the work may still be included. Any relevant copyright owner becoming aware of that use is invited to contact ACER should that copyright owner have any concern.
